PART 2 – GENERAL TERMS AND CONDITIONS (GTC)

ARTICLE 1 – Scope

1.1 Application of the GTC
These General Terms and Conditions of Sale apply whenever you place an order with the seller LA MAIN NOIRE LABO SAS via its website, www.lamainnoirecollective.com.
Contracts between the Client and LA MAIN NOIRE LABO SAS and/or its successors and assigns are binding on both parties.
The Client acknowledges having read the terms at the time of placing their order by ticking the box “Validate the General Terms and Conditions of Sale.”

1.2 GTC prevail over other documents
These General Terms and Conditions of Sale are accessible at any time on this website and take precedence over any other version or contradictory document. Failure by one party to enforce any provision within these GTC shall not be interpreted as a waiver of such provision in the future.

Based on updates to our offerings or legislative reforms, these GTC may be amended. Such modifications become applicable immediately upon being published online and will not apply to previously concluded transactions.

ARTICLE 2 – Orders

2.1 How to place an order
To purchase a product or service, the Buyer must:

  • Verify and confirm their order;
  • Make payment as per the stated terms;
  • Confirm their order and payment.

Order confirmation implies acceptance of these terms, acknowledgment of full understanding, and a waiver of any other purchase conditions.
All provided data and the recorded confirmation shall constitute proof of the transaction. Confirmation is equivalent to a signature and agreement to the operations performed.

2.2 Verification of recorded information
The information recorded by the Buyer when placing an order is binding. LA MAIN NOIRE LABO SAS cannot be held liable for non-receipt of the order confirmation email or delivery issues due to errors in the recorded information.

2.3 Order confirmation and invoicing
LA MAIN NOIRE LABO SAS will send a confirmation email upon recording the order. The data recorded by LA MAIN NOIRE LABO SAS constitutes proof of the order’s nature, content, and date.
A sale is concluded only upon order confirmation.

2.4 Issuance of an Invoice
An invoice detailing the order’s content, price, and taxes will be emailed to the Client alongside the order confirmation.

2.5 Legitimate refusal of sale
LA MAIN NOIRE LABO SAS reserves the right to cancel any order from a Client who has not paid for their subscription or with whom there is an unresolved payment dispute for a previous order.

ARTICLE 3 – Pricing

3.1 Prices applicable at the time of purchase
Prices are stated in Euros, both excluding and including VAT.
LA MAIN NOIRE LABO SAS reserves the right to change its prices at any time. However, the price listed in the catalog on the order date is the only applicable price.
Unless otherwise stated, the listed prices do not include transport and delivery fees, which are calculated based on package weight, carrier, and the geographical location chosen by the Buyer.

ARTICLE 4 – Payment Terms

4.1 Payment Methods
All orders must be paid in Euros, via credit card or direct debit through Gocardless.
The Client guarantees that they are authorized to use the payment method and that sufficient funds are available to cover the transaction. Payments by credit card are debited immediately upon order.

ARTICLE 5 – Delivery

5.1 Delivery Times
Indicative delivery times:

  • France and EU: 4 to 20 days from the order date.

For deliveries exceeding 30 days, the Client may terminate the contract and receive a refund.

ARTICLE 6 – Right of Withdrawal and Returns Policy

6.1 Withdrawal Right
In accordance with the law, Clients purchasing from the website have a withdrawal period of 14 days from receiving the product. Requests must be sent to lamainnoireorders@gmail.com.

6.5 Exceptions for Food Products
Per the law, no withdrawal right applies to food products for hygiene and safety reasons.

ARTICLE 7 – Seller’s Liability

Products benefit from legal guarantees of conformity and against hidden defects. However, differences between product images and actual products cannot lead to compensation unless they are misleading.

ARTICLE 10 – Applicable Law – Language

These General Terms and Conditions of Sale (GTC) are governed by and subject to French law. They are drafted in the French language. In the event they are translated into one or more other languages, only the French text shall be deemed authentic in the case of a dispute.

ARTICLE 11 – Customer Service

Each customer request will be handled as promptly as possible, and we will strive to provide the most appropriate response.
